The Member States of the European Union (EU) are launching and drawing up European directives in the European Commission in Brussels. These directives are adopted by the Council of the EU and the European Parliament (EP) by qualified majority as part of a codecision procedure. The EU directives are binding, i.e. they become mandatory by all EU Member States States.In framework of the UNITED Nations Economic Commission for Europe (UN-EEC) in Geneva, WP.29, and that its subsidiary bodies draw up the regulations of the 1958 agreement in cooperation with all parties to the agreement and non-governmental organisations (NGOs). The provisions of the United Nations are not binding, but if a contracting party (P.C.) decides to apply a UN regulation, adoption becomes a legally binding act. A P.C. that has adopted a regulation under the 1958 agreement may grant typed receipts in accordance with this regulation and must accept the type of receipt of any other P.C. that has adopted the same regulation. At present, some European directives are technically equivalent to those of the United Nations or only concern the requirements of the UN regulation. The One-GTR is the technical regulation established under the 1998 agreement, which does not refer to a reception or certification procedure, as mentioned in EU directives or UN regulations. UN regulations are considered candidates for the development of the UN-GTR. Once the contract is signed, each state will treat it according to its own national procedures. In the Netherlands, Parliament`s approval is required.
Once the authorization is granted within the state`s own internal procedures, it informs the other parties that they agree to be bound by the contract. This is called ratification. The treaty is now officially binding on the state. Mutual recognition of the authorizations issued under the 1958 agreement is intended to facilitate international trade in vehicles and their components. When an item is approved by one of the parties to the 1958 agreement pursuant to a United Nations regulation, all other contracting parties that have signed the same regulation recognize that approval. This avoids repeated testing and approval of components in different countries to which they are exported. This helps reduce design, manufacturing and registration costs and delays, as well as the commissioning of vehicles and their components.
